DO NOT PROCEED WITH THIS SWEEPSTAKES IF YOU ARE NOT LOCATED IN THE UNITED STATES OR IN THE DISTRICT OF COLUMBIA.

OFFICIAL RULES

1. NO PURCHASE NECESSARY. This iPod Touch sweepstakes (the “Sweepstakes”) is open to legal residents of the 50 United States and the District of Columbia (excluding overseas military installations, Puerto Rico and other U.S. Territories) who are at least 18 years of age as of the date of entry. No purchase is necessary. This Sweepstakes is void where prohibited, restricted or taxed. Employees of Infinite Mind, LC, its subsidiaries, affiliates, advertising and promotion agencies not eligible, nor are the immediate families and members of the households of such employees. This Sweepstakes may not be used in connection with any form of gambling. Each person submitting an entry agrees to accept and be bound by all of the rules stated herein.

2. SWEEPSTAKES DATES. The Sweepstakes begins on Monday, January 1, 2007 at 12:01 AM MST and ends on May 31, 2007 at 11: 59 PM MST.

3. HOW TO ENTER/PLAY/WIN. To access the Sweepstakes, complete the entry form on the Previous Page or at http://www.infmind.com/sweepstakes.asp and follow the instructions to enter. Entry is free. Limit one (1) entry per household. Each entry must be fully and accurately completed and timely submitted. Limited one (1) winner per calendar month. Winners will be determined by random drawing from all eligible entries on or about 10:00 AM MST on each third day of the following Sweepstakes period. Any person who attempts to enter with multiple email addresses or under multiple identities or uses any other device to enter multiple times will be disqualified. All entries shall be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

4. PRIZES. Each winner will receive one (1) iPod Touch, a value of $299. No transfer, substitution or cash redemption of any prize is permitted, except that Sponsor reserves the right in its sole discretion to substitute a prize with cash or with a prize of comparable or greater value. All federal, state and local taxes shall be the sole responsibility of each winner. The odds of winning depend entirely on the number of eligible entries received by Sponsor. Each prize is awarded “AS IS” and without any warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

5. NOTIFICATION. Each winner will be notified by email to the email address provided on the entry form or by phone. The winner must claim the prize by reply email within seven (7) days from the time the notification by email is sent or by contact via the phone, or the prize will be forfeited and an alternate winner will be chosen. No other means of communication will constitute acceptance of the prize.

6. GENERAL RULES AND REGULATIONS. By submitting an entry in the Sweepstakes, each person grants Sponsor the right, unless prohibited by law, to use his/her name, address, telephone number, email address, voice, pictures, likeness, and the like, without compensation, for the purpose of running the Sweepstakes and further grant all such rights to Sponsor for the purpose of advertising and publicizing the goods and services of Sponsor and all matters relating to the Sweepstakes in any manner or medium, throughout the world in perpetuity. Each such person agrees to hold the Sponsor and its employees, agents, officers, directors, members, managers, subsidiaries and affiliates harmless from and against any claims, liability or damages for injury or loss to any person or property relating to participation in the Sweepstakes or the delivery, receipt and/or subsequent use or misuse of any prize awarded.

Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should any of the following occur: (a) viruses, bugs, unauthorized human intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, or (b) earthquake, flood, fire, storm or other natural disaster, act of God, labor controversy or threat thereof, civil disturbance, disruption of public markets, war or armed conflict (whether or not officially declared). Sponsor shall not be responsible for technical, network, telephone, computer hardware or software failure or malfunctions of any kind, or for any late, lost, delayed, misdirected, incomplete, illegible or unintelligible entries.

7. CONSTRUCTION. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any person submitting an entry, shall be governed by, and construed in accordance with the laws of the State of Utah, without giving any effect to any choice of law or conflict of law rules or provisions that would cause the application of laws of any jurisdiction other than Utah. The invalidity or unenforceability of any provision in this Official Rules shall not affect the validity or enforceability of any other provision.
